Warranty
This Warranty and Customer Agreement
('Agreement') is entered into by and
between nFusion Canada Inc. ('nFusion')
and the purchaser of nFusion's
equipment, whether a broker, dealer or
end user ('Customer') and shall be
effective upon acceptance of the terms
and conditions of this Agreement by
Customer. Acceptance shall be deemed to
have occurred upon Customer's purchase
of nFusion equipment, whether such
purchase is made directly from nFusion
or from a broker or dealer of nFusion's
products.
1. Product Use & Acknowledgement.
Customer agrees to not use any nFusion
products in any unauthorized illegal
manner for interception of pay satellite
television services. Customer
acknowledges that such use is illegal
and carries substantial civil and
criminal penalties under applicable
Federal, State and International law.
Customer shall not engage in the
interception of pay satellite television
services without proper authorization
from the broadcast satellite provider
and payment of required charges. By
purchasing an nFusion product, Customer
represents and warrants that he/she is
of legal age and accepts sole
responsibility for Customer's compliance
with International, Federal, State and
Local laws when using nFusion products.
Customer agrees to indemnify, defend and
hold nFusion and its directors,
officers, employees and affiliates
harmless from and against any and all
claims, damages or liabilities rising
out of or resulting from Customer's
unauthorized use of satellite television
equipment purchased from nFusion or
nFusion's licensed and approved dealers
or any other affiliate of nFusion.
Customer further acknowledges that
Federal law prohibits the unauthorized
interception of satellite
communications. In particular, Section
553(a)(10) of Title 47 of the United
States Code states as follows: 'No
person shall intercept or receive or
assist in intercepting or receiving any
communications service offered over a
cable system, unless specifically
authorized to do so by a cable operator
or as may otherwise be specifically
authorized by law.'
2. Declaration of Intent. Customer
hereby represents and warrants that
Customer understands that applicable law
provides for substantial criminal and
civil penalties for the theft of
satellite television services, and that
Customer will not use nFusion products
in any manner in violation of applicable
law, specifically, Customer represents
and warrants that Customer will not
intercept any satellite television
signal without proper authorization from
satellite service provider and payment
of all lawful charges and will only use
the equipment in accordance with all
applicable laws.
3. Limited Warranty. nFusion warrants
that the product purchased by Customer
shall be free from defects in
workmanship or materials for a period of
1 year from the date of purchase by
Customer. If, at any time during the
warranty period, the product has a
defect in workmanship or material,
nFusion shall repair or replace it (at
nFusion's sole option) within a
reasonable period of time. An original
invoice is required as proof of the
purchase date. nFusion's option with
respect to this matter shall be final.
This warranty does not cover defects or
malfunctions resulting from software
transfers, misuse, abusive operation,
tampering, negligence, improper use,
insufficient care or any act beyond the
control of nFusion. WARNING: When you
buy a receiver from nFusion, your
receiver will be sent to you with the
latest firmware available at the time
the unit was manufactured. nFusion will
not provide support to products that
have otherwise been modified by the end
user, nor does nFusion support
programming modifications to the
firmware and software used in its
products, and if any such modifications
have been made, all warranties shall be
automatically void.
To avoid invalidating the warranty
offered hereunder, Customer should use
only the official software and upgrades
available from nFusion's website at
www.nfusioncanada.ca together with
programming performed by trained
satellite installation technicians. No
other software or firmware should be
used, as such use will automatically
void all warranties and support. nFusion
does not support the use of any software
or firmware other than the software or
firmware that was installed on the
product by the manufacturer or that is
available from nFusion's official web
site at www.nfusioncanada.ca. nFusion
declines to respond to any inquiries
regarding unauthorized modifications,
unauthorized software, and unauthorized
firmware. |
